Overview

This website is operated by Village Gourmet (IW) Ltd. Throughout the site, the terms “we”, “us” and “our” refer to Village Gourmet. Village Gourmet offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Make a contract with us

When you place an order with us, you are making an offer to buy goods. We will send you an e-mail to confirm that we have received your order. Your order is an offer to buy from us. There will be no contract of any kind between you and us unless and until we accept your order and in the case of goods to be delivered to you, when we despatch the goods to you. At any point up until then, we may decline to supply the goods to you and provide you with a full refund, without giving any reason. At the point of the goods being despatched, a contract will be made between you and us.

In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this. We will refund your order, and there will be no contract between us.

By placing an order with us, you agree to and accept these terms, as well as our privacy policy and the terms of website use.

This contract is covered by English law.

Amendments

We cannot guarantee that once an order has been placed and paid for, any amendments can be made. If you do wish to amend your order you must notify us by phone as soon as possible and, provided the order has not been submitted for preparation, we will endeavour to amend it.

Payment

All payments are taken at the time the order is placed. We will not reserve or dispatch goods before payment us received.

All products quoted on the website are in GBP and, where appropriate, include Value Added Tax. We reserve the right to amend prices of products displayed on our website without prior notice. The prices on our website are always the most up-to-date correct prices.

Ordering

You can place an order on our website, over the telephone or via email. We accept payment via most credit and debit cards both on our website and also via invoice. We do not currently accept telephone payments.

If you wish to place an order by telephone, you will be sent an invoice by email which must be paid by BACS within 48 hours of receipt.

Cancellations and amendments

As our products are prepared in small batches and produced to order, we regret that once an order is dispatched it is not possible to cancel it and refunds cannot be given.

We cannot guarantee that once an order has been placed and paid for, any amendments can be made. If you do wish to amend your order you must notify us by phone as soon as possible and, provided the order has not been submitted for preparation, we will endeavour to amend it.

Product information

Images of goods on this website are for illustrative purposes only. We have made every effort to display as accurately as possible the colours of our goods that appear on this website. However, we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the actual goods.

Whilst we try to be as accurate as possible, all information provided is approximate and is provided in good faith. Any photographic props such as plates, glasses and other utensils are not included unless otherwise stated.

All products are produced in nut environments and accordingly may contain nuts. Please check each product’s ingredients for allergens, which have been listed in bold. If any further information is required about our products, such as serving tips or nutritional information, we would be happy to provide it, prior to purchase.

We reserve the right to vary the dimensions, specifications, descriptions and quantities of products displayed on our website without prior notice. Please check serving sizes on the website carefully.

Alcohol

Under the Licensing Act 2003 it is an offence to purchase or attempt to purchase alcoholic liquor if you are under the age of 18. By placing an order, which includes alcohol, with us, you are confirming that you, and the recipient (if the order is a gift) are legally able to purchase alcohol AND over the age of 18.

Hampers which contain alcohol cannot be left in a safe place and will require a signature upon delivery by a person over the age of 18.

Product Shelf Life
In respect of ambient hampers we guarantee a minimum shelf life of 28 days for the earliest dated product. If you are purchasing a Christmas hamper the minimum shelf life will typically be 3rd January. Our shelf life promise is only guaranteed if the delivery of the hamper is successful on the carrier’s first attempt.

Returns

In the unlikely event that your package is damaged during transit, please accept the delivery and contact us as soon as possible. Accepting a damaged delivery will not affect your rights. Refusing delivery without first consulting us could possibly result in the goods being disposed of by the courier. If possible, please take photographs to show evidence of the damage.

If you or your recipient have received a damaged or defective hamper or if we have made a mistake with your order the following terms apply:

1. If there is a problem with the goods, please notify us by email or in writing providing details of the problem within 48 Hours of receipt. It’s helpful if you can provide us with a digital photograph of the problem as this makes the identification of the issue faster.

If the goods were damaged in transit and we require the goods returned, we will reimburse the return costs up to the cost of the delivery method you selected on purchase, if we have asked you to return the goods. Please do not return the goods without contacting us first and getting confirmation that we require you to return them. You will not be charged for the collection of your item nor for the delivery of a replacement hamper.

  1. If required we will refund the cost of the hamper in full or we will replace the hamper. If the same hamper is not available we will replace with a hamper of equal or higher value.

Limitation of Liability

We cannot accept liability for any consequential loss, damage or expense caused by a failure in our service of any sort. This includes the cost of purchases made to replace an order that fails to arrive for any reason.

Delivery

Please check the goods on delivery – any goods found to be missing or damaged should be notified to us within 24 hours.  This is to aid us in investigating any possible loss or damage in transit with our delivery operative.

For Isle of Wight deliveries only; we will not accept responsibility for loss or damage if you instruct the us/the courier to leave the goods unattended.

Sometimes, for reasons beyond our control our courier may be prevented from delivering your goods as planned. These might include things such as accidents, breakdowns, fire, flood, storm, severe weather, acts of God, war, riot, civil commotion, malicious damage or the default of our suppliers. We will try to put things right as soon as possible however we cannot be responsible where this causes a delay or failure in delivering your goods.

You cannot change the delivery address once your goods have been dispatched. Please make sure you give the correct address and postcode for the recipient. Additional charges will be made for redirection or for re-delivery due to address or postcode error.

You will receive a text/email notification regarding your delivery from our courier. If you have delivery instructions for the courier, please advise us when placing your order using the comments box. It is your responsibility to ensure that you or the recipient can receive the parcel on the delivery date chosen by you. If buying a gift, it is your responsibility to notify the recipient of the parcel’s arrival. A telephone number, preferably mobile, must be provided with the order and if you have provided an email address then you should also receive a tracking email from our courier company which you can use to check your delivery’s progress.

If no one is home to receive delivery a card will be left and a second attempt will be made on the next working day. If the second attempt is also unsuccessful you will be required to collect the parcel from the courier depot. Alternatively, you can use the tracking information to redirect your parcel to a neighbour or alternative address, however this may incur an additional fee which will be payable by you.

Please note that we may not be able to track the exact location of your parcel, nor estimate a delivery time.
